CPA Australia City Taxation Discussion GroupRecent interesting tax cases
The discussion group session will be discussing recent tax cases. Recently taxpayers have succeeded in a number of cases that have decided important principles of tax law. In some cases, this has affected stated policy of the Commissioner. The Commissioner never likes to lose so at least three of the cases are subject to appeal or applications for leave to appeal. However for now the decisions are binding on the Commissioner.
Case 1 Issues – UPEs and Division 7A:1.
Case 2 Issues – capital reductions and deemed dividends
Case 3 Issues – Mixed Supplies and apportionment on input tax credits
Case 4 Issues: Royalties, withholding tax and diverted profits tax

Alan Jessup is a partner in the Corporate Division based in Sydney. He has Masters Degrees in both Law and Taxation, is an accredited mediator and a Chartered Tax Adviser.
Alan has significant experience in trust law and superannuation and the taxation matters associated with the same. This has included the drafting of trust deeds of various types including superannuation funds and the provision of advice in relation to the taxation and regulatory requirements for superannuation funds.
